The Department of Homeland Security (DHS) has announced a significant new registration requirement affecting Canadian snowbirds staying in the United States. This Interim Final Rule will be published in the Federal Register on March 12, 2025, and takes effect on April 11, 2025.

Who Is Affected

This requirement directly impacts Canadian citizens who:

  • Cross the U.S. border by land
  • Stay in the United States for 30 days or longer

The Registration Gap

Most Canadians who drive across the border are not currently issued Form I-94 documents.  Under the new Interim Rule, Canadians staying in the U.S. for 30+ days must now register online.

New Requirements

Canadian visitors who have been in the United States for 30 days or longer must:

  1. Create an account with USCIS
  2. Complete the new Form G-325R online at https://my.uscis.gov/
  3. Carry their “Proof of Alien Registration” document at all times while in the United States

Important Considerations

  • Legal Consequences: Failure to comply with registration requirements is punishable by:
    • Fines up to $5,000 or imprisonment for up to six months or both
