This month, Attorney Jennifer Behm assisted a client with a Humanitarian Parole request. Humanitarian Parole enables an otherwise inadmissible individual to enter the U.S. temporarily due to a compelling emergency. In this case, our client was a Canadian citizen who had a minor son with an extremely rare medical condition. His son had a crucial need for life-saving treatment in the U.S. that was not offered anywhere in Canada. Our client, however, was inadmissible to the U.S. due to several criminal convictions in the past. When he contacted our firm, Ms. Behm was eager to assist this family in need.
Ms. Behm prepared a detailed parole request packet, which included an explanation of the applicant’s inadmissibility and his compelling reason for seeking parole – his son’s medical condition, the crucial need for treatment, and the fact that the treatment was not offered in his home country. We also included specific supporting documentation evidencing these facts. We sent the packet to CBP officers at the Peace Bridge for review and received a telephone call the next day good news – they had approved the request for Parole. Our attorney then met our client at the port-of-entry the next day, and he was admitted for a 3-month period to accompany his son for the entire duration of his treatment.

Who can apply for Humanitarian Parole?
Anyone can make an application on behalf of someone who is outside of the United States and has an urgent need to enter the country. Individuals may also self-petition for Humanitarian Parole if they are outside the United States.
Who approves this type of application?
Humanitarian parole may be issued by U.S. Customs and Border Protection (CBP) if the traveler seeking the parole is at the U.S. port-of-entry. Each parole issued by CBP is issued at the discretion of the Port Director. Humanitarian parole is also sparingly issued by U.S. Citizenship and Immigration Services (USCIS).
What are Common Types of Parole Requests?
Reasons for Parole include but are not limited to the following:
– To obtain medical treatment
– To visit a critically ill relative
– Family reunification and to prevent inhumane separation (adults and children)
– Civil and criminal court proceedings
– Other emergent requests (determined on a case-by-case basis)
It is important to note that humanitarian parole is granted on a case-by-case basis, and it does not confer any permanent immigration status. A person granted humanitarian parole must depart the U.S. prior to its expiration date or risk negative immigration consequences.
