As immigration enforcement continues to dominate the national conversation, local policies are drawing increased scrutiny, including right here in Buffalo.

Rosanna Berardi, Managing Partner of Berardi Immigration Law, appeared on WBEN radio to explain the legal implications of Buffalo Mayor Ryan’s recent executive order addressing how city employees interact with federal immigration authorities.

The order instructs city agencies not to assist with civil immigration enforcement unless required by law. While the announcement sparked public debate, Berardi emphasized that immigration enforcement remains firmly under federal authority, and local executive orders do not override federal law.

“I think it’ a political way of saying to city residents, look, we’re here to protect you. But because immigration law is very convoluted, many people think it’s something that it’s not.” Berardi explained.

Berardi stressed that while cities may limit voluntary cooperation, federal agencies such as ICE can still act when operating under proper legal authority, including valid judicial warrants.
