As immigration enforcement activity raises questions across the country, ABC News Live turned to Berardi Immigration Law Managing Partner, Rosanna Berardi Esq., for critical guidance on constitutional rights and what to know if ICE comes to your door.

In her interview, Berardi emphasized the most important distinction everyone should understand: not all warrants are created equal. Judicial warrants, signed by a judge, grant authority to enter a home. Administrative warrants, issued by ICE or DHS, do not. You are not required to open your door for an administrative warrant.

“If ICE knocks on your door, or pounds on your door, and says ‘We want to come in,’ you have to say to them, and you can say behind the door, ‘I need to see your warrant.’”

Most critically, Berardi stressed that everyone physically present in the United States has constitutional rights, including due process and Fourth Amendment protections—regardless of immigration status. Her message was clear: understand the difference between warrant types, know your rights, stay calm, and don’t assume every piece of paper labeled “warrant” carries the same legal authority
