Gabriella Agostinelli, Senior Associate Attorney at Berardi Immigration Law, recently had a client present a successful TN Management Consultant case to Customs and Border Protection located at the Peace Bridge port of entry in Buffalo, New York. This client was applying for the renewal of his current TN under the management consultant designation. Renewals in this particular category can be tricky as CBP often questions how the applicant can be a consultant if they weren’t able to complete the consulting assignment on the original TN. In a situation like this, we need to prove that the project the applicant was consulting on simply has not completed yet and therefore, the consulting services are still necessary. In this case, we were able to prove that the client was in fact consulting on a new phase of a project for a third-party entity. Our client’s TN was successfully renewed for a nine-month period.
