U.S. Citizenship and Immigration Services (USCIS) is beginning to implement its second phase of premium processing for certain petitioners who have a pending Form I-140, Immigrant Petition for Alien Workers. This is specifically meant for Form I-140s filed under EB-1 and EB-2 classifications under the E13 multinational executive and manager classification or E21 classification as a member of professions with advanced degrees or exceptional ability seeking a national interest waiver (NIW). Those petitioners who want to request a premium processing upgrade must file a Form I-907, Request for Premium Processing Service.
USCIS announced that beginning August 1st, 2022, they will accept Form I-907 requests for:
- E13 multinational executive and manager petitions received on or before July 1st, 2021
- E21 NIW petitions received on or before August 1st, 2021
USCIS says that it will reject premium processing requests for Form I-140 classifications if the receipt date is after the date that is listed above. USCIS has 45 days to take an adjudicative action on these cases that request premium processing for newly included Form I-140 classifications. USCIS will not accept new Form I-140s with premium processing requests at this time. USCIS also stated that as of July 1st, 2022, they no longer accept the old edition (09/30/2020) version of Form I-907, the new version was published May 24th, 2022.
USCIS has noted that it is committed to expanding premium processing and adhering to legislative requirements that state that the expansion of premium processing must not cause an increase in processing times for regular immigration benefit requests.
