USCIS Updates Their Guidance on Expedite Requests

U.S. Citizenship and Immigration Services (USCIS) have updated their policy manual to include new guidance as to how they determine whether or not a case warrants expedited treatment. USCIS says that this new guidance is going into effect immediately. 

The update:

  • Clarifies the criteria and circumstances under which USCIS considers expedite requests from nonprofit organizations as determined by the Internal Revenue Service (IRS);
  • Provides more examples of when USCIS can consider expedite requests made by federal, state, or local agencies including labor and employment agencies;
  • Adds examples to further illustrate how the expedite criteria relates to emergencies and urgent humanitarian reasons; and
  • Explains some circumstances that may affect or delay USCIS’s ability to expedite one’s application or petition.

This update provides a lot of great clarifications for not only USCIS agents, but also those individuals who may be attempting to expedite their applications/petitions.
