RB National Post Ice at Airports

When immigration policy meets real-world travel, confusion is almost guaranteed, and that’s exactly where immigration attorney  Rosanna Berardi steps in.

In a recent feature by The National Post, Berardi shared critical insight into the growing presence of Immigration and Customs Enforcement (ICE) agents at U.S. airports and what it means for Canadian travelers.

ICE vs. TSA: Not Even Close

As airport operations strain under staffing shortages, ICE agents have been deployed to assist, but they are not simply a substitute for TSA.

Berardi made it clear: the difference isn’t just in uniforms, it’s in authority.

“They definitely look more enforcement oriented than TSA, which is more of a screening look… there is a different vibe and more authority at the airport.”

While TSA focuses on security screening, ICE officers have the power to detain, arrest, and investigate immigration status, a completely different level of authority that travelers should understand before heading to the airport.

Can You Ask for TSA Instead of ICE?

Short answer: don’t try it.

Berardi advises against attempting to choose which officer you deal with at the airport.

“Law enforcement in general doesn’t like that kind of thing… Wherever they wave you towards, I would definitely just go there.”

Trying to redirect yourself to a TSA agent isn’t just ineffective, it could raise unnecessary attention. Not exactly the kind of spotlight you want when traveling internationally.

Should Canadians Be Worried?

Here’s the straight talk: if your immigration status and documentation are in order, you’re likely fine. But ICE’s expanded presence does mean one thing: Greater scrutiny is possible. Unlike TSA, ICE officers are trained to look beyond your boarding pass. They can review immigration history, visa status, and documentation in ways TSA simply cannot.

Prepare Before Your Travel

This isn’t about panic, it’s about preparation. The increased presence of ICE at airports is a reminder that immigration enforcement doesn’t stop at the border. It can show up at your departure gate, too.

Understanding your rights, your status, and how to respond in these situations is essential, and that’s exactly why insights from experienced immigration counsel matter now more than ever.
