Rosanna Berardi, Managing Partner of Berardi Immigration Law, was recently featured on Bill O’Reilly’s No Spin News to explain the legal questions surrounding Minnesota Congresswoman Ilhan Omar’s U.S. citizenship.

Rep. Omar has retained legal counsel amid questions about whether she properly qualified for citizenship when she immigrated to the United States. Speaking from Buffalo, Rosanna cut through the noise and explained that the central legal issue is narrower than much of the public conversation suggests. It comes down to one question: how old was she when she derived citizenship through her father?

Rosanna explained the rule at the heart of the matter:

“The rules say that you must be under 18 years old and unmarried to derive citizenship through a family member, which she did through her father. Now at issue is, was she 18 already? And if so, that would disqualify her as a U.S. Citizen.”

She also clarified what the government can and can’t pursue at this stage. A criminal case is off the table due to the statute of limitations, but a civil denaturalization proceeding is still possible:

“If they have clear and convincing evidence, they can try to denaturalize her if indeed she was over 18 at the time.”
