This week, National Post covered legal insight from Rosanna Berardi, Esq., Managing Partner at Berardi Immigration Law, on recent visa revocations in the U.S., in particular, how they’re being driven by reactions to Charlie Kirk’s death, and how social media content is playing a role.

Rosanna explains that U.S. Customs and Border Protection (CBP) and the State Department have sharply increased their post-issuance screening of visa holders. In short: even after a visa is approved, individuals may now face new questions, reviews, or even cancellations based on behavior, statements, or information that emerges, especially online.

“Foreign nationals like Canadians have no guaranteed speech protections when seeking entry. This raises concerns that Canadians’ political expression, even if lawful at home, could jeopardize their ability to cross the border or remain in the U.S.” Rosanna said. “However, it is unlikely that Canadians would be deported or refused admission for this speech. It’s important to remember that all foreign nationals in the U.S., even Canadians, are entitled to due process and a chance to challenge their removal.”

Rosanna says this is a clear signal from the current administration: the U.S. is leaning hard on strict immigration enforcement, and wants near-perfect compliance from visa holders. Travelers should expect that routine border crossings or airport entries may involve extra scrutiny, including questions about social media posts, affiliations, or online comments.
